In the role of parent and/or guardian to the minor enrolled at BSM, the User claims to act subsequent to obtaining the explicit consent of the other parent and declares to be fully aware of the criminal liability and administrative consequences arising from the forgery of documents and false statements.

The Privacy Policy contains the disclosure provided pursuant to Legislative Decree no. 30 n.196 / 2003 (hereinafter “Code regarding the protection of personal data”) and art. 13 of the European Regulation (EU) n, 2016/679 and is inspired by Recommendation n. 2/2001 that the European authorities for the protection of personal data, gathered in the Group established by art. 29 of Directive n. 95/46 / EC, adopted on 17 May 2001 to establish minimum requirements for the on-line collection of personal data.

The disclosure is provided only for the Website and is not in any way related to the various websites to which the User may be redirected through links contained within the Website, which perform the redirection to portals and information systems managed by third parties in relation to which the ownership, the methods and the aims are totally foreign to BSM.

The Privacy Policy is governed by Italian law and in particular by the Regulation governing personal data processing, carried out by anyone who is resident or based in Italy and / or in the countries of the European Union, and guarantees that personal data processing is carried out in compliance with fundamental rights and freedoms, as well as in respect of the dignity of the interest party, with particular reference to privacy, personal identity and the right to protection of personal data.

The Privacy Policy may be modified or simply updated, in whole or in part, in the light of any legislative changes; changes and updates to the Privacy Policy will be binding as soon as they are published on the website.

BSM decides independently on the purposes and methods of processing, as well as on the security procedures to be applied to ensure the confidentiality, integrity and availability of data.

3. Scope of processing

Navigation within the website is free and does not require authentication credentials, except the access to the "Parents” section by the Parents of the enrolled students.

The provision of the User's personal data and/or of each pupil enrolled to BSM (such as, but not limited to, personal data, phone number and email address, hereinafter the "Data"), may be requested by the BSM Software to allow the completion of the procedures referred to in point 1 above (hereinafter, globally, the "Service").

As mentioned above, the provision of data is optional, yet its absence will make it impossible for BSM to offer the Service.

BSM proposes a link to the Admissions procedure that refers to the aforementioned information notice, which must be accepted by the User to access the Service along with the User's positive statement of having received the consent from the other parent (if applicable) of the pupil for whom the application request for entry to BSM is completed. It is made in the knowledge that, in case of a positive result from the assessments for entry to BSM, the documents for acceptance of a place at BSM will have to be signed on paper(although scanned and signed documents are accepted) by both parents (if this applies) or by the guardian, authorizing the processing of their own personal data and of the data belonging to the pupils for whom the application for entry to BSM was made.

4. Data processing method

 Data processing is carried out mainly electronically by BSM and by other parties who, selected with care for their reliability and competence, conduct instrumental operations to achieve the purposes strictly related to the use of the Website and its maintenance.

Data will not be disclosed to third parties, except in cases where the disclosure is required by law or for purposes envisaged by the law for the pursuit of which the consent of the interested subject is not required. In such cases, Data can be made available to third parties who will process it independently and exclusively for such purposes (for example, in the case of requests made by the police or by courts or other competent authorities).

BSM will not distribute data in any way.

5. Duration of the processing

Data is processed for the time strictly necessary to achieve the purposes for which it was collected, in accordance with the provisions contained in the Regulation, and in particular respecting the rules of lawfulness, correctness, relevance and non-excess. In any case, this period of time will not last more than 10 years, at the end of which the Data Controller will proceed to the automatic cancellation of the personal data collected.

6. Data Security

Specific security measures are observed by BSM to prevent, in addition to unauthorized access, also the loss and illicit or incorrect use of Data.

7. Data Processing Location

The data collected by the website is processed at the Data Controller’s office and at the Google Cloud Platform (GCP) Web Hosting data centre located in London (UK), in his capacity of Data Processor and processes personal data on behalf of the Data Controller in compliance with European standards.

8. Rights of the User pursuant to art. 15 of the Regulation

The User has the right to exercise at any time and freely the rights referred to in art. 15 of the Regulation, such as accessing their Data, obtaining confirmation of the existence or not of personal data concerning them, even if not yet registered, to know their origin and content, to verify their accuracy and to request their integration, updating or correction, as well as to request cancellation, transformation into anonymous form or blocking of data that may be processed in violation of the law, as well as to oppose, for legitimate reasons, to their treatment.

BSM cannot guarantee Users that the measures adopted for the safety of the Website and the transmission of his/her Data on the Website, limit or exclude any risk of unauthorized access or dispersion of Data by devices used by the Users, therefore we recommend all Users make sure their computer is equipped with suitable software for the protection of data transmission, both incoming and outgoing (such as for example, updated antivirus systems, firewalls and anti-spam filters).

9. Subjects who may process Users’ and Students’ Data

 Data of the User and of each pupil enrolled to BSM is completed and handled exclusively by BSM and by the staff assigned by BSM in order to allow the use of the Service, and it is understood that the details of the data processing controller officer will be provided on request, subject to the User’s rights as per Art. 15 of the Regulation.

10. Cookies Policies

In compliance with the Provision of the Privacy Authority "Identification of simplified procedures for the information and the acquisition of consent for the use of cookies” dated 8 May 2014, published in the Official Gazette no. 126 of 3 June 2014, this document provides information regarding the use cookies by BSM or by possible third parties, and the ways in which cookies can be managed by the User.

Nella qualità di genitore e/o esercente la patria potestà sul soggetto minore iscritto a BSM, l’Utente dichiara di agire previo espresso consenso dell’altro genitore e dichiara di essere pienamente consapevole delle responsabilità penali e degli effetti amministrativi derivanti dalla falsità in atti e dalle dichiarazioni mendaci.

La Privacy Policy contiene l’informativa resa ai sensi del D.Lgs. 30 n.196/2003 (codice in materia di protezione dei dati personali) e dell’art. 13 del Regolamento Europeo (UE) n, 2016/679 ed è ispirata alla Raccomandazione n. 2/2001 che le autorità europee per la protezione dei dati personali, riunite nel Gruppo istituito dall’art. 29 della direttiva n. 95/46/CE, hanno adottato il 17 maggio 2001 per individuare alcuni requisiti minimi per la raccolta di dati personali on-line.

L’informativa è resa solo per il Sito e non è in alcun modo riferita ai diversi siti internet cui l’Utente possa essere reindirizzato tramite link contenuti all’interno del Sito, che effettuano rinvio a portali e sistemi informatici gestiti da soggetti terzi in relazione alle cui titolarità, modalità e finalità BSM è del tutto estranea.

La Privacy Policy è regolata dalla legge italiana e in particolare dal Regolamento Europeo che disciplina il trattamento dei dati personali effettuato da chiunque è residente o ha sede in Italia e/o nei Paesi della Unione Europea, e garantisce che il trattamento dei dati personali si svolga nel rispetto dei diritti e delle libertà fondamentali, nonché della dignità dell’interessato, con particolare riferimento alla riservatezza, all’identità personale e al diritto alla protezione dei dati personali.

La Privacy Policy potrà essere modificata o semplicemente aggiornata, in tutto o in parte, alla luce di eventuali modifiche legislative; le modifiche e gli aggiornamenti della Privacy Policy saranno vincolanti non appena pubblicati sul Sito.

BSM decide in modo autonomo sulle finalità e sulle modalità del trattamento, nonché sulle procedure di sicurezza da applicare per garantire la riservatezza, l’integrità e la disponibilità dei dati.

3. Finalità del trattamento

La navigazione all’interno del Sito è libera e non richiede credenziali di autenticazione ad eccezione dell’accesso alla sezione “Genitori” da parte dei Genitori degli alunni iscritti.

La fornitura di dati personali dell’Utente e/o di ciascun soggetto iscritto a BSM (quali, a titolo esemplificativo, dati anagrafici, numero di telefono ed indirizzo di posta elettronica di seguito, i “Dati”) potrà essere richiesta dal software BSM ai fini del completamento delle procedure di cui al punto 1 (di seguito, globalmente, il “Servizio”).

Come anzidetto, il conferimento dei Dati è facoltativo ma il loro mancato conferimento rende impossibile a BSM offrire il Servizio.

Alla procedura di Admissions BSM propone un link che rimanda all’informativa sopra riportata, che dovrà essere accettata dall’Utente ai fini dell’accesso al Servizio, unitamente alla positiva dichiarazione dell’Utente di aver ricevuto il consenso dell’altro genitore del soggetto per cui è formulata la richiesta di valutazione ai fini dell’iscrizione a BSM (se presente) e della consapevolezza che, in caso di positivo esito dell’esame della richiesta di valutazione ai fini dell’iscrizione a BSM, la richiesta di iscrizione a BSM dovrà essere sottoscritta in formato cartaceo da entrambi i genitori (se presenti) o dal soggetto esercente la patria potestà, autorizzando il trattamento dei dati personali propri e dei soggetti per cui è formulata la richiesta di valutazione ai fini dell’iscrizione a BSM.

4. Modalità di trattamento dei Dati

Il trattamento dei Dati è eseguito con modalità prevalentemente elettroniche da BSM e da altri soggetti che, opportunamente selezionati quanto ad affidabilità e competenza, svolgono operazioni strumentali al perseguimento delle finalità strettamente connesse all’uso del Sito ed alla sua manutenzione.

I Dati non saranno comunicati a terzi, salvo i casi in cui la comunicazione sia obbligatoria per legge o sia necessaria per finalità previste dalla legge per il perseguimento delle quali non sia richiesto il consenso dell’interessato; in tali casi, i Dati potranno essere resi disponibili a terzi soggetti che li tratteranno in modo autonomo e unicamente per le suddette finalità (ad esempio, nel caso di richiesta avanzata dalle forze di polizia o dalla magistratura o altri enti competenti).

I dati non verranno in alcun modo diffusi da BSM.

5. Durata del trattamento

I Dati vengono trattati per il tempo strettamente necessario al conseguimento degli scopi per cui sono stati raccolti, in ossequio alle disposizioni contenute nel Regolamento, ed in particolare rispettando le regole di liceità, correttezza, pertinenza e non eccedenza. Ad ogni modo tale periodo di tempo non si protrarrà oltre 10 anni, allo scadere del quale il Titolare procederà alla cancellazione automatica dei dati personali raccolti.

6. Sicurezza dei Dati

Specifiche misure di sicurezza sono osservate da BSM per prevenire, oltre ad accessi non autorizzati, anche la loro perdita e gli usi illeciti o non corretti.

7. Luogo del trattamento

I dati raccolti dal sito sono trattati presso la sede del Titolare del trattamento e presso il datacenter del Web Hosting Google Cloud Platform (GCP) ubicato a Londra (Regno Unito) in qualità di Responsabile del trattamento e tratta i dati personali per conto del Titolare in conformità alle norme europee.

8. Diritti dell’Utente di cui all’art. 15 del Regolamento

L’Utente ha facoltà di esercitare in ogni momento e liberamente i diritti di cui all’art. 15 del Regolamento, quali accedere ai propri Dati, ottenere la conferma dell’esistenza o meno di dati personali che lo possano riguardare, anche se non ancora registrati, di conoscerne l’origine e il contenuto, di verificarne l’esattezza e di chiederne l’integrazione, l’aggiornamento o la rettifica, così come di chiedere la cancellazione, la trasformazione in forma anonima o il blocco dei dati eventualmente trattati in violazione della legge, nonché di opporsi, per motivi legittimi, al loro trattamento.

L’Utente potrà accedere ai propri dati in qualsiasi momento ed esercitare i diritti di cui all’art. 15 del Regolamento mediante comunicazione scritta da inviarsi a BSM con sede legale in 20134 Milano (MI), Via Pisani Dossi Carlo Alberto, 16, e-mail: secretary@bsm.school or fax: 0221094224, dove potrà conoscere altresì l’elenco aggiornato degli eventuali responsabili del trattamento nominati ai sensi dell’articolo 28 del Regolamento.

BSM non può garantire ai propri Utenti che le misure adottate per la sicurezza del Sito e della trasmissione dei Dati sul Sito limitino o escludano qualsiasi rischio di accesso non consentito o di dispersione dei Dati da parte di dispositivi in uso agli Utenti, per cui consigliamo a ciascun Utente di assicurarsi che il proprio computer sia dotato di software adeguati per la protezione della trasmissione in rete di Dati, sia in entrata che in uscita (quali a titolo esemplificativo, sistemi antivirus aggiornati, firewall e filtri antispamming).

9. Soggetti che possono trattare i Dati dell’Utente e dell’Alunno

I Dati dell’Utente e/o di ciascun soggetto iscritto a BSM sono trattati esclusivamente da BSM e dal personale incaricato da BSM al fine di permettere la fruizione del Servizio, restando inteso che in caso di nomina di responsabili del trattamento BSM ne fornirà opportuna indicazione, salvi i diritti dell’Utente di cui all’articolo 15 del Regolamento.

10. Cookies Policy

In osservanza al Provvedimento del Garante della Privacy “Individuazione delle modalità semplificate per l’informativa e l’acquisizione del consenso per l’uso dei cookie dell’8 maggio 2014, pubblicato sulla Gazzetta Ufficiale n. 126 del 3 giugno 2014, il presente documento fornisce informazioni relative alle modalità di utilizzo dei cookies da parte di BSM o da eventuali soggetti terzi, ed alle modalità attraverso le quali i cookies possono essere gestiti dall’Utente.
